Hawaii's Thousand Friends v. City and County of Honolulu, et al. Hawaii Supreme Court Case No. 15923
Affirmed Circuit Court decision declaring that the Dept. of Land Utilization must obtain a special management area use permit prior to any demolition at Camp Kailua. Although an agency's decision carries a presumption of validity in a generic a appeal (HRS 91-14), Friends' petition for declaratory judgment was brought as an original action under HRS 632-1.
